Este trabajo analiza el conflicto judicial que surgió en torno a la tasa portuaria creada por el municipio de Necochea en 2015 para financiar el mantenimiento de la infraestructura vial utilizada por el transporte con destino a Puerto Quequén. El litigio, promovido por las principales empresas exportadoras y cámaras del sector se extendió por siete años y culminó con el fallo de la Cámara en lo Contencioso Administrativo de Mar del Plata en el año 2024 que declaró la validez de la tasa y revocó la sentencia de primera instancia que la había considerado inaplicable. El fallo vuelve a poner en tensión problemáticas históricas y estructurales de la provincia en torno al alcance del poder tributario municipal. Desde un enfoque histórico-institucional, el artículo analiza cómo estos conflictos se inscriben en procesos de descentralización y privatización portuaria y en las limitaciones estructurales que condicionan la autonomía financiera de los municipios.

This paper analyzes the judicial conflict that arose regarding the port tax created by the Municipality of Necochea in 2015 to finance the maintenance of road infrastructure used by transportation bound for Puerto Quequén. The litigation, brought by major export companies and industry chambers, lasted seven years and culminated in the 2024 ruling of the Administrative Litigation Chamber of Mar del Plata, which upheld the validity of the tax and overturned the first-instance decision that had deemed it inapplicable. The ruling once again brings to the forefront historical and structural issues of the province concerning the scope of municipal taxing powers. From a historical-institutional perspective, the article examines how these conflicts are embedded in processes of decentralization and port privatization and in the structural limitations that constrain the financial autonomy of municipalities.
